The terms of the eMarGator scheduling text message program.

The program#

eMarGator Scheduling Notifications is a transactional text message program operated by EMAR GATOR. It sends work scheduling messages to employees of the care provider agencies that use eMarGator.

Messages tell an employee about:

  • a shift that has been assigned to them;
  • an open shift at their own workplace that needs coverage;
  • confirmation that a reply to a coverage request was received.

This program is not marketing or advertising. It is never used to send messages to the people who receive care, and messages never contain health information, a resident or patient name, a diagnosis, or a medication.

Who receives messages#

Only staff members of an agency that uses eMarGator, at the mobile number on their own staff record, and only after that staff member has opted in. We do not buy, rent, or share phone number lists, and we do not send messages to anyone who has not opted in.

How to opt in#

Opt-in happens inside the eMarGator mobile app, in Settings, through a dedicated consent checkbox that is unchecked by default and is never pre-checked. Checking the box is the act of consent, and the checkbox label asks for that consent explicitly:

“I agree to receive text messages (SMS) from eMarGatorabout my work schedule and shift coverage”

Directly beneath the checkbox, this disclosure is shown:

“By checking this box, I agree to receive recurring text messages (SMS) from eMarGatorabout my work schedule and shift coverage at the mobile number on my staff record. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.”

This checkbox does only this. Agreeing to receive text messages is separate from accepting the eMarGator Terms of Service and Privacy Policy, and it is optional — it is not required to have an account or to use any part of eMarGator, and it can be turned off at any time in the same screen.

Message frequency#

Message frequency varies. Messages are sent in response to real events in a schedule, so how many arrive depends on how often shifts at that workplace need coverage. Most staff receive a small number of messages per month.

Cost#

Message and data rates may apply. EMAR GATOR does not charge for these messages, but your mobile carrier may. Check your plan.

How to opt out#

Reply STOP to any message to stop receiving them. STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT are all honored. You will get one confirmation from the carrier and then no further messages from this program. You can also turn the setting off in the eMarGator app, which has the same effect.

Opting out of text messages does not affect your account, your schedule, or anything else in eMarGator. Notifications continue to appear in the app.

If you opt out and later want messages again, turn the setting back on in the app. You can also reply START or UNSTOP, which lifts your carrier’s block — but messages resume only if you had previously opted in through the app.

Carriers#

Message delivery depends on your mobile carrier, and carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
